1. Acceptance Of These Terms
These Terms & Conditions govern your access to and use of Phurti websites, software, applications, and related services provided by Sentele, located at Dwarka, New Delhi, India (hereinafter "Phurti", "we", or "us"). By accessing or using Phurti, you agree to these terms.
If you use Phurti on behalf of a restaurant, company, or other organization, you represent that you have authority to bind that organization to these terms.
2. Eligibility And Accounts
- You must provide accurate information when creating or managing an account.
- You are responsible for safeguarding your login credentials and for activity that occurs under your account.
- You must promptly notify Phurti if you suspect unauthorized access or misuse of your account.
3. Using The Service
Phurti is intended for restaurant operations, including tables, orders, kitchen workflows, printing, staff management, customer-facing ordering, and related communications. You may use the service only in compliance with applicable law and these terms.
- You may not use Phurti to break the law, infringe rights, transmit malicious code, interfere with the service, or attempt unauthorized access.
- You may not use the service to send unlawful, deceptive, harassing, or spam communications.
- You may not reverse engineer, copy, resell, or misuse the platform except as expressly allowed by law or with our written permission.
4. Restaurant Responsibilities
- Restaurants are responsible for their menus, pricing, taxes, discounts, table codes, staff access, customer fulfilment promises, and the accuracy of operational data they configure in Phurti.
- Restaurants are responsible for ensuring they have the rights and permissions needed to upload content, contact customers, and process customer information through their own business workflows.
- Restaurants remain responsible for complying with laws and regulations that apply to their business, including food service, tax, labour, advertising, and consumer protection requirements.
5. Customer Orders And Communications
Phurti may help a restaurant collect customer orders and operational messages, but the restaurant is the party that accepts, fulfils, modifies, rejects, refunds, or otherwise handles the underlying order and customer relationship.
Phurti is not responsible for restaurant preparation times, stock availability, delivery timelines, food quality, fulfilment disputes, or staff conduct at a restaurant.
6. B2B SaaS Relationship vs Diner Use
Phurti operates as a Business-to-Business (B2B) Software-as-a-Service (SaaS) provider for restaurants. We provide the technology infrastructure for restaurant operations.
For diners (end-customers) using Phurti-powered ordering interfaces, your primary relationship and transaction is directly with the restaurant. Phurti acts solely as a technology provider processing orders and messages on the restaurant's behalf, not as a merchant of record, food preparation entity, or delivery provider.
7. Third-Party Services
Certain features may depend on third-party providers such as authentication, hosting, communications, print tooling, or messaging channels. Those third-party services may be governed by their own terms and privacy practices.
Phurti is not responsible for outages, restrictions, or policy changes imposed by third-party providers outside our reasonable control.
8. Fees, Trials, And Plan Changes
If Phurti offers paid plans, trials, pilots, or custom pricing, the applicable commercial terms will be presented at signup, in an order form, or in a separate written agreement. Unless otherwise stated there, fees are non-refundable to the maximum extent permitted by law.
We may change, replace, or discontinue plans and features from time to time. We will aim to give reasonable notice when a change materially affects active paid customers.
9. Intellectual Property
Phurti and its associated software, design, branding, content, and documentation are owned by Phurti or its licensors and are protected by applicable intellectual property laws.
You retain rights in content and business data you submit to the service, but you grant Phurti the rights reasonably necessary to host, process, display, transmit, and back up that content in order to operate the service.
10. Availability, Disclaimers, And Liability
Phurti works to keep the service available and reliable, but the service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted availability, perfect accuracy, or error-free operation.
To the maximum extent permitted by law, Phurti will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunities arising from or related to the service.
To the maximum extent permitted by law, Phurti's aggregate liability for claims arising out of or relating to the service will not exceed the amounts paid by you to Phurti for the relevant service during the 12 months before the event giving rise to the claim.
11. Suspension And Termination
We may suspend or terminate access to the service if we believe there is a security issue, a violation of these terms, non-payment, unlawful conduct, or misuse that could harm Phurti, restaurants, customers, or third parties.
You may stop using the service at any time. Sections that by their nature should survive termination will continue to apply, including provisions relating to payments, intellectual property, disclaimers, liability, and disputes.
12. Governing Law, Updates, And Contact
These terms are governed by the laws of India, excluding conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India. We may update these terms from time to time by posting a revised version and updating the date above.
